With the release of Stage 2 of the Review of Model Defamation Provisions, centred upon the question of internet intermediary
liability, CAMLA and JWS bring together a panel of defamation experts for a webinar discussion.

This is an opportunity to join with leading tech players, expert counsel, an academic and an eminent defamation Judge in
considering the next round of changes during the consultation period for Stage 2.

PANELISTS

Kieran Smark SC
Kieran Smark SC was an associate to Justice Gaudron in 1989 and 1990, was
admitted as a barrister in 1991 and took silk in 2007. He practices in media/
defamation law, appearing both for and against publishers, and also in commercial
and equity matters. Recent appearances include Rush v Nationwide News as well
as the appeals in Fairfax Media v Gayle and Leyonhjelm v Hanson-Young. Kieran is a
member of the NSW Bar Committee on defamation law reform.

Clayton Noble – Microsoft Australia and New Zealand
Clayton Noble is a senior legal counsel for Microsoft Australia and New
Zealand. Clayton leads commercial transactions, advises Microsoft’s commercial
and consumer businesses and manages litigation including defamation defence
for Microsoft in Australia and New Zealand. Clayton has previously worked
in technology fields with premier law firms in Sydney, Silicon Valley and San
Francisco, as in-house counsel for leading software and corporate advisory firms.

Her Honour Judge Judith Gibson, District Court of NSW
Her Honour Judge Gibson has been a District Court Judge since 2001, where she
administers the Defamation List.

Dr Daniel Joyce, UNSW Law & Justice
Dr Daniel Joyce is Senior Lecturer at UNSW Law & Justice and a member of the
Allens Hub for Technology, Law & Innovation at UNSW. Daniel’s teaching and
research is focused on media law and international law. He is a co-author of Media
Law: Cases, Materials and Commentary (OUP, 2015) and his most recent publication
is Informed Publics, Media and International Law (Hart, 2020).
